Intellectual Property
All content published and made available on our Site is the property of Chai Studios and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

Sale of Goods
These Terms and Conditions govern the sale of goods and services available on our Site.

The following goods and services are available on our Site:

• Makeup Services

These Terms and Conditions apply to all the goods and services that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods we provide. You agree to purchase goods from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Payments
We accept the following payment methods on our Site:

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Shipping and Delivery
When you purchase goods from our Site, the goods will be delivered through one of the following methods:

• Standard Post Delivery (NZ). Delivery takes 5-10 business days.
  

Delivery will take place as soon as reasonably possible, depending on the delivery method selected. Delivery times may vary due to unforeseen circumstances. Please note that delivery times do not include weekends and statutory holidays.

You will be required to pay delivery charges in addition to the price for the goods you purchase.

If you purchase goods from us for delivery to a destination outside New Zealand your purchase may be subject to import duties and taxes applied by the destination country. You are responsible for paying any such duties or taxes. Please contact your local customs office for more information before making a purchase. We are not responsible for the payment of any such duties or taxes and are not liable for any failure by you to pay them.

You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.

Returns
Returns can be made by mail. To initiate a return, email us at: hello@chaistudios.co.nz with your order number in the subject.

Non-refundable deposits (makeup services)

To secure your appointment at Chai Studios, a non-refundable deposit of 20% of the total service cost is required at the time of booking. This confirms your appointment and ensures that the necessary time and resources are reserved exclusively for you.

By booking with Chai Studios, you agree to the following terms:

• Deposit Requirement: A deposit of 20% of the total service cost is required at the time of booking to confirm your appointment. This deposit will be applied towards the total cost of your service.
• Non-Refunable Deposit: The deposit is non-refundable. If you cancel or reschedule your appointment, the deposit will not be refunded, as it covers the time and preparation reserved for your session.
• Rescheduling: If you need to reschedule your appointment, we ask that you provide at least 48 hours’ notice. The deposit will be applied to the new date, but if the appointment is rescheduled less than 48 hours in advance, the deposit will be forfeited.
• Cancellation: If you cancel your appointment without providing 48 hours’ notice, the deposit will not be refunded. No-shows will result in the forfeiture of the deposit.
• Final Payment: The remaining balance of your service is due on the day of your appointment - no later.

By confirming your appointment, you acknowledge that you have read, understood and agreed to this non-refundable deposit policy. If you have any questions or concerns, please feel free to contact Chai Studios before booking.

Punctuality (Makeup Services)

To ensure that all clients receive the best service and attention, we kindly ask that your arrive on time for your scheduled appointment. Please note the following:

• Arrival Time: We request that clients arrive a few minutes before and/or at the scheduled time for their appointment. Should you anticipate being delayed or unable to arrive on time, please inform us as soon as possible.
• Delayed Arrival: If your arrive after the scheduled time, your appointment may be shortened to accommodate other clients, and the full service fee will still apply. In cases of significant delay, we reserve the right to cancel and/or reschedule your appointment.
• Late Fees: A late fee may be applied if you arrive after the scheduled start time, depending on the duration of the delay and the impact on Chai Studios schedule.

Allergy Disclosure (Makeup Services)

At Chai Studios, your health and safety are our top priority. To ensure the best and safest experience, we ask that all clients inform us of any known allergies or sensitives prior to their makeup appointment.

By confirming your appointment, you acknowledge that you have read and understood your responsibility in disclosing any relevant allergies. If you have any concerns or questions, please let us know prior to your appointment.

By booking an appointment with Chai Studios, you agree to the following:

• Disclosure of Allergies: You are required to inform us of any allergies or sensitivities to makeup products, ingredients, or materials that could be used during your appointment. This includes, but is not limited to, skin allergies, reactions to specific makeup products, or any other medical conditions that may affect the application of makeup.
• Responsible Communication: It is your responsibility to disclose any allergies before your appointment. Please communicate any relevant information directly to Chai Studios during the booking process and/or during your appointment.
• Product Use: While we take all necessary precautions to use safe and high-quality products, we cannot be held liable for any allergic reactions if full disclosure of allergies was not provided. If you are unsure of any product ingredients, we encourage you ask for clarification before we proceed.
• Patch Tests: If you have a history of sensitivities or allergies to makeup, we recommend conducting a patch test. If you have a specific product you would like to use during your appointment, you are welcome to bring it to your appointment. If you choose not to have a patch test, we will proceed with the understanding that you are aware of the risks.
• Emergency Protocols: In the event of an allergic reaction during your appointment, we will immediately discontinue the application, remove the product, and seek appropriate medical attention if necessary. Chai Studios is not responsible for any allergic reactions.

Photo and Video Policy (Makeup Services)

At Chai Studios, we are proud to highlight our work and the incredible transformations we achieve for our clients. To share these experiences with a broader audience, we enjoy capturing photographs and videos during our appointments, which may be utilised for promotional purposes.

By proceeding with your appointment, you acknowledge that you have read, understood, and agreed to this policy. If you have any questions or concerns regarding this, please feel free to discuss them with Chai Studios before your appointment.

By booking an appointment with Chai Studios you are agreeing to the following:

• Consent to Record: During your makeup session, photos and videos may be taken by Chai Studios for promotional and marketing purposes, including but not limited to social media, website content, advertisements and other promotional materials.
• Opt-Out Option: If you prefer not to have your photos or videos taken, please notify us prior to your appointment. Chai Studios respects your privacy, and you are welcome to decline any photos or recordings.
• Usage of Media: Any images or videos captured may be used on Chai Studios & Nikita Chaithoo’s social media platforms, website, print materials or other marketing avenues. Your image will be used solely for these purposes and will not be sold to third parties.
• Confidentiality and Respect: All media shared will be handled wit the utmost respect for your image and privacy. We will not tag or share personal details without your permission.

Consumer Protection Law
Where the Consumer Guarantees Act 1993, the Contract and Commercial Law Act 2017, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Limitation of Liability
Chai Studios and our directors, partners, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless Chai Studios and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law
These Terms and Conditions are governed by the laws of New Zealand.

Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
